ASSUMPTION OF RISK, RELEASE, CODE OF CONDUCT, AND WAIVER OF LIABILITY

In consideration of the opportunity to participate in the 2026 Sports Photography Gathering (“Event”) provided by the Doug Pensinger Photography Fund (“Organization”), I, the undersigned, hereby forever release, waive, and hold harmless Organization and its officers, directors, employees, members, volunteers, representatives and agents (collectively, the “Organization Parties”) from any and all liability, injury, damage, loss, or expense that may arise, directly or indirectly, now or in the future, regardless of whether caused by fault on the part of the Organization Parties, in connection with my participation in the Event or travel to or from the Event.  

By participating in the Event, I voluntarily assume all known and unknown risks related to any liability, injury, damage, loss or expense connected with my participation in the Event as described above. I promise not to sue any of the organization parties for any of the claims that I have released, waived, and discharged. I understand that this release and waiver is intended to be as broad and inclusive as is permitted by law, and that if any portion of this release and waiver is held invalid, the remainder will continue in full legal force and effect. This release and waiver shall extend to and be binding upon me and my estate, heirs, executors, administrators and personal representatives. 

I understand that my participation in the Event is completely voluntary on my part and permitted at Organization’s discretion, and I agree to abide by all policies and procedures as established by Organization. If my conduct does not meet reasonable standards of behavior, including without limitation following the instructions provided by Organization, I understand that my participation in the Event may be revoked. 

I will comply with all applicable laws and will not violate the rights of any other person or entity or engage in any unlawful conduct or willful misconduct. I understand that the DPPF is committed to equality and inclusion and will not tolerate discrimination or harassment, including disparaging remarks, unwanted sexual advances, or any other type of harassment based on race, color, religion, gender, sexual orientation, national origin, age, disability, or any other protected class.

Portions of the Event may be photographed, videotaped, or otherwise recorded. I authorize the Organization to take photographs or other likenesses of me on any medium (“the Images”) and irrevocably grant the Organization a nonexclusive license to publish, display, and reproduce the Images in whole or in part, in any and all media whether now known or hereafter devised, without further compensation or consideration, for the Organization’s nonprofit educational purposes. I waive all rights of inspection or approval with regard to any use of the Images for the Organization’s purposes.

By completing registration for this event, I signify that I have read this Assumption of Risk, Release, Code of Conduct, and Waiver of Liability; understand it and its terms and conditions; and agree to be bound legally by its terms and conditions.
